Peoria Drivers License Reinstatement Lawyers

A DUI charge usually results in a temporary suspension of driving privileges known as a statutory summary suspension. This penalty is civil in nature (not criminal) and you may have basis to challenge the suspension in court. If you are convicted of the criminal charge of driving under the influence (DUI), however, the conviction will result in an automatic revocation of a driver's license. Once your license is revoked, it is necessary to prove to the Secretary of State that you are a safe and responsible driver in order to have your license reinstated.

Your administrative hearing is crucial to the reinstatement of your driver's license. If you answer just one question wrong, reinstatement could be denied.

At Hanna & Hanna, P.C., we help clients challenge suspensions and prepare for their administrative reinstatement hearings, providing them with guidance and support throughout the process. Contact us online or call our Peoria law firm toll free at 866-575-8553 to schedule a free consultation.

Automatic Driver's License Suspension (Statutory Summary Suspension)

In Illinois, a statutory summary suspension means that your driving privileges will be suspended for a specified period of time and then reinstated. This suspension is imposed if someone is arrested for DUI/DWI with a blood alcohol concentration (BAC) of .08 or greater, or the person is found to be under the influence of an illegal substance. Additionally, your driver's license will be automatically suspended if you refuse to submit to chemical testing.

You have a right to a judicial hearing to challenge the statutory summary suspension of your license. At the hearing, the judge may order the suspension lifted or rescinded if certain circumstances exist, such as a violation of your due process rights. Our attorneys carefully examine each DUI case to determine whether a lawful basis exists to challenge your suspension.

Driver's License Reinstatement Following a DUI Conviction

The Secretary of State will revoke your driver's license if you are convicted of the criminal charge of DUI. Unlike a suspension, a revocation lasts for an indefinite period of time and will remain revoked until you take steps to regain your driving privileges at an administrative hearing. A person seeking reinstatement or a restricted driving permit bears the burden of producing evidence that they are a safe and responsible driver.

Our attorneys will counsel you throughout the administrative hearing process in attempt to have your driver's license reinstated. We will show that you are not at risk of becoming a repeat DUI offender by helping you prepare an effective testimony and presenting any relevant evidence, such as completion of a drug and alcohol treatment program. At Hanna & Hanna, P.C., we spend as much time as is needed in order for you to feel confident and prepared for the hearing.
